Understanding E-2 Treaty Investor Qualifications

To obtain an E-2 treaty investor visa, an investor must be a citizen of a country that has a treaty of commerce and navigation with the United States. The investor must also invest a significant amount of capital into an existing U.S. business or start a new one. The investor must also be entering the U.S. to develop and direct the enterprise that they are investing in.

The amount that must be invested can vary, but guidelines state that the amount of capital is:

  • Significant to the total cost of either purchasing an established enterprise or starting a new one
  • Large enough to ensure the investor’s commitment to operating the endeavor
  • Large enough to be successful in order to support the investor and their dependents

E-2 treaty investor visa holders can stay in the U.S. for up to two years with the option of extensions and the ability to change their status. Investor immigrants may also have the opportunity to bring their spouses and unmarried children under the age of 21.
